The purpose and legal basis for our processing of your personal data
Five2one Estate processes customer and personal data to provide our assistance in connection with the purchase, sale and management of real estate and under our Five2one sharing concept.
The basis for our processing of customer and personal data is thus first and foremost the agreement with the customer and the necessity to assist the customer in connection with the customer’s order. with buying, selling and financing real estate.
It is also based on the consent given by requesting our newsletters, material about the Five2one concept, being included in our buyer and seller directory and receiving material about homes in Spain.
In addition, we are covered by the Money Laundering Act, which obliges us to carry out a know-your-customer procedure in connection with the solution of the task.

The bases for our processing of special categories of personal data can be found in Article 9(2)(f) (establishment of a legal claim) and (g) (substantial public interest, including compliance with the Money Laundering Act) of the General Data Protection Regulation.
We process information about criminal offenses pursuant to section 8(3) of the Data Protection Act (safeguarding a legitimate interest, including, for example, compliance with the Money Laundering Act).
We further apply the basis for processing general data, “legitimate interest” in Article 6(1)(f) of the GDPR in cases where there is a dispute about our work, including if a complaint is raised or legal proceedings are initiated. We do this because we assess that our interest in being able to meet claims in this context outweighs the data subject’s interest in protecting their privacy. At the same time, it is our assessment that the data subject, in the event of a complaint/litigation, can reasonably expect us to store and use data about the data subject.
Categories of personal data
We process all types of personal data, including general, confidential and special categories/sensitive personal data. However, we do not collect and process information about criminal offenses.

Finally, we exchange case and customer information internally and we exchange personal data on customers to buyers, sellers, real estate providers, promoters, brokers, agents, banks or other party representatives for the purpose of registering a customer as a customer of Five2one Estate and as part of our fulfillment of the task that we have undertaken for the customer and which inherently involves the exchange of personal data and confidential information.
Transfer to recipients in third countries, including international organizations
We do not disclose or transfer personal data to recipients outside the EU/EEA unless otherwise agreed in advance with the customer.
Where the personal data originates from
First and foremost, we get our personal data from our customers when they engage with our ads and social media and give consent for us to collect this personal data. We then receive information when customers agree with us that we will provide them with assistance in connection with the service. with buying/selling/financing real estate or they want to acquire a share of a home under the Five2one concept.
In addition, we may obtain information from publicly available sources, parties to the case, other advisors or authorities as appropriate.
Storage of your personal data
We undertake to store the personal data, including electronic data, for an appropriate period after the end of the case, which is generally not less than 5 years. We therefore also retain all personal data for a similar period of time.

Contact information is collected in the form of name and email. Only personal data provided by the visitor is collected.
Recipients of personal data
The personal data provided will not be disclosed outside the company. The personal data is transferred (not disclosed) to MailChimp in the USA, where it is used to send newsletters. MailChimp cannot use the personal data for its own purposes and therefore acts solely on our instructions. A data processing agreement has been entered into with MailChimp and data transfer is based on Standard Contractual Clauses (SCC).

The personal data is stored as long as you subscribe to the newsletter or until you withdraw your consent.
When registering for an event:

When registering for a physical event (contact form), we process the personal data provided for the purpose of registering registrants and for the purpose of sending emails with service messages about the event/webinar up to and immediately after the event.
